By accessing or using mpaxmarketing.com, the ProductSage platform, or any affiliated applications or services (the "Site"), you represent that you have full authority to bind yourself and any entity you represent. Your continued use of the Site constitutes your acceptance of these Terms of Use, our Privacy Policy, and any other legal notices we publish.

Acceptance of Terms

By using this Site, you agree to comply with and be legally bound by these Terms of Use, whether or not you become a registered user. If you do not agree, do not access or use the Site.

Eligibility

You affirm that you are at least 18 years of age and are able and competent to enter into and comply with these Terms. The Site is not intended for individuals under the age of 13. We do not knowingly collect personal data from children under 13.

User Conduct

You agree not to:

Contributions

You may submit a template, a template change, or an AI Meta change through our contribution form. When you submit, you grant M-PaX Marketing ownership of what you submit. You confirm that you have the right to make that grant.

We review and edit every submission, and we decide what to publish. M-PaX Marketing is the owner of record of every template we publish. We credit you by name on the published record.

Intellectual Property Rights

All content on the Site, including software, design, graphics, trademarks, and other intellectual property, is the exclusive property of M-PaX Marketing or its licensors. You are granted a limited, non-exclusive license to use the Site for personal or internal business purposes only.

Data Collection and Use

We collect personal data as outlined in our Privacy Policy. You consent to our use of data as described there. You retain ownership of your data, except for what you contribute under Contributions. We will use your data only as necessary to provide our services and to comply with legal obligations.

Limitation of Liability

To the maximum extent permitted by law, we disclaim all liability for damages of any kind arising from your use of this Site, including direct, indirect, incidental, and consequential damages. Our maximum liability will not exceed the greater of $100 or the amount you paid for the services in the past 12 months.

Indemnification

You agree to indemnify and hold harmless M-PaX Marketing, its affiliates, employees, and contractors from any claim, demand, or damage, including reasonable attorney's fees, arising out of your use of the Site or your breach of these Terms.

Termination

We may suspend or terminate your access to the Site at any time, for any reason, with or without notice. Upon termination, your right to use the Site will cease immediately.

Changes to the Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the Site after such changes constitutes your acceptance.

Governing Law

These Terms are governed by and construed under the laws of the State of North Carolina, without regard to conflict of law principles.
